Alabama, Arkansas, Connecticut, Delaware, Florida, Georgia, Illinois, Indiana, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, Ohio, Oklahoma, Pennsylvania, South Carolina, South Dakota, Texas, Utah, Virginia, West Virginia, Wisconsin, Wyoming, and Washington, D.C.

Red lights — and the reasons

Banned or effectively banned: Idaho, Iowa, Kansas, Mississippi, North Dakota, Oregon, Rhode Island, Vermont, Washington, and Hawaii shut intoxicating hemp products out of the mail (or out of the state entirely).

Dispensary-only states: Alaska, Arizona, California, and Colorado route all THC drinks through licensed cannabis retail, so direct-to-door shipping is off the table.

Store shelves only: Tennessee lets low-dose hemp drinks sit in stores but bans shipping them to consumers.

We also can't ship to U.S. territories, APO/FPO military addresses, or outside the United States.

Dose caps worth knowing

A few states cap milligrams per serving or per container — Minnesota, for instance, limits hemp beverages to 5mg per serving and 50mg per container. Check your state's current rules before ordering the high-dose stuff; that part's on you.

How this map gets drawn

The 35-state footprint is legal cartography, not ambition. A state earns its spot only when hemp-derived Delta-9 beverages are unambiguously legal to sell, ship, and receive under both federal law and that state's own statutes.

Ambiguous states, hostile states, and states mid-lawsuit stay off the map until the dust settles — we would rather lose a sale than mail you a legal problem. Checkout enforces all of it automatically: an address outside the footprint simply will not process.

Operations, for the practical-minded: every order dispatches same-day, seven days a week. Shipping is $5.99 flat and free past $60, which sits neatly under the first Pack Deals tier, so a properly built cart clears both lines at once.

Some states require adult signature at the door — if that is yours, make sure someone 21+ is around when the truck shows. Typical transit is two to four business days anywhere in the zone.

Keep checking. State hemp law is the most volatile map in American commerce right now — legislatures are rewriting beverage rules every session, and the federal framework arriving in late 2026 (The Pour covers it without spin at /blogs/the-pour) will redraw lines again.

This page updates the moment a state flips in either direction. What we cannot do is the workaround thing: shipping to a buddy in a legal state for a hand-off violates our terms and can drag your home state's laws into your life in ways nobody wants.

Worth restating while you are here: everything we ship is hemp-derived, at or under 0.3% Delta-9 by dry weight, batch-tested by independent labs with every certificate posted on lab proof, and sold to adults 21+ only. Where we ship, the law is clear.

On stores with bigger maps

You will find competitors shipping to more states than we do. Their lawyers are braver than ours, or paid to be.

Aggressive readings of state hemp statutes are how packages end up seized and customers end up arguing with a refund policy, so our rule stays boring: if defending a shipment in front of that state's attorney general sounds like a bad afternoon, the state stays off the map.

We re-check the footprint against live statutes on a rolling basis and move it in both directions as legislatures move — states have joined and left this list before, and both will happen again. Traveling?

Order ahead to your in-zone destination instead of driving cans across state lines; hauling hemp products into a prohibition state is personal legal exposure we would never recommend acquiring. Edge case we did not cover?
